Terms of service

Website Terms and Conditions

1. About these terms
1.1 These terms apply when you use our website at redbackboots.com.au (our website) or when you buy from us on it. Please read them before you place an order. By placing an order, you agree to them.
1.2 Who we are. In these terms, "Redback", "we", "us" and "our" mean Redback Boot Company Pty Ltd (ABN 38 003 845 805) of 150-152 Euston Road, Alexandria NSW 2015. "You" means the person using or buying from our website.
1.3 Other policies. Our Privacy Policy, Shipping and Returns Policy and Warranty Policy also apply.
1.4 Purchases. These terms cover purchases on our website. If you bought Redback boots from a stockist, that store’s terms apply to your purchase, but our manufacturer’s warranty still applies to boots bought from an authorised stockist. You can claim through the stockist or directly with us with your proof of purchase.
1.5 Australia only. We currently sell and deliver to addresses in Australia only. Our Global links take you to websites run by independent overseas distributors. Those websites have their own terms (see clause 10.2).

Part A – Buying from us
2. Your rights under the Australian Consumer Law
2.1 Nothing in these terms, or in any of our policies, excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded (your Consumer Rights).
2.2 Our 30-day  comfort trail and our 12-month manufacturer's warranty are in addition to your Consumer Rights.

3. Prices and products
3.1 Prices are in Australian dollars and include GST. Delivery charges are shown at checkout before you pay. A price change won't affect an order we have already accepted.
3.2 Leather is a natural material, so colour, grain and markings vary from pair to pair, and screens show colours differently.

4. Placing an order
4.1 We accept your order when we email your order confirmation. A contract is formed at that point.
4.2 We may cancel an order after accepting it only if:
1. the product was listed at an obviously incorrect price because of a genuine error;
2. the product is no longer available and we cannot supply it within a reasonable time; or
3. we reasonably suspect the order is fraudulent or unauthorised.
If we cancel, we will tell you and refund everything you paid.
4.3 You can ask us to cancel your order before it is dispatched. If we can stop it, we will refund everything you paid. If not, please use our returns process (clause 7).

5. Payment and promotions
5.1 Payment is taken when you place your order. If you pay with Afterpay [or another buy now, pay later provider], that provider's own terms apply to the payment arrangement.
5.2 Unless an offer says otherwise, discount codes can be used once per customer, can't be combined with other codes or offers, and expire on the date stated in the offer. If you return a product bought with a discount, we refund the amount you actually paid.

6. Delivery
6.1 Delivery options, charges and estimated delivery times are shown at checkout and in our Shipping Policy. Delivery times are estimates.
6.2 Please check your delivery address before you order. If a parcel can't be delivered because the address was wrong or incomplete, you may need to pay to have it redelivered.
6.3 Risk in the products passes to you when they are delivered to your address, including when they are left there in line with your delivery instructions. Ownership passes to you once we have received full payment.
6.4 If your order arrives damaged, incomplete or incorrect, please contact us and we will make it right.

7. Change-of-mind returns
7.1 30-day comfort trial. If you buy boots on our website and they’re not right for you, you can return them within 30 days of delivery for a full refund. You’re welcome to wear them during that time, so you can see how they feel at work. We cover the return shipping.
To be eligible, please return the boots in their original box, with no damage beyond normal wear and no alterations (for example, removed tags, or changes to the boots or how they are designed to be used). If boots come back damaged, we’ll assess them under our manufacturer’s warranty instead.
7.2 We refund the price you paid for the purchased product, not including original delivery charges, to your original payment method within 5 business days of receiving your return. See our Returns Policy for how to start a return.
7.3 This clause is about change of mind. If a product is faulty, clause 8 applies instead, and these conditions don't limit your Consumer Rights.

8. Faulty products and our warranty
8.1 Redback products bought from us or an authorised stockist come with our 12-month manufacturer’s warranty against defects in materials and workmanship, in addition to your Consumer Rights. Our Warranty Policy explains what it covers and how to claim.
8.2  We assess warranty claims from the photos you send us, so you won’t need to post your boots to us to make a claim. We will pay the cost of sending a repaired or replacement product to you.

9. Safety footwear
9.1 Products described as safety footwear are tested to AS 2210.3:2019. It is up to you, or your employer, to choose footwear that suits the hazards of your workplace.

Part B – Using our website

10. Using our website
10.1 Please use our website lawfully. You must not interfere with it, try to gain unauthorised access to it, or use automated tools to copy or scrape its content.
10.2 Our website links to websites we don't control, including our overseas distributors' websites and social media. Those websites have their own terms, and we are not responsible for them.
10.3 Redback and the Redback logo are registered trade marks of Redback Boot Company Pty Ltd. You may view and share our website content for personal, non-commercial use, but not copy or use it commercially without our written permission.

11. Reviews
11.1 Reviews must be honest, based on your own experience, and must not be offensive, misleading or unlawful, or include other people's personal information. We publish genuine reviews whether positive or negative, and remove a review only if it breaches this clause. By posting a review, you allow us to publish it with your first name or display name.

Part C – General (applies to Parts A and B)

12. Our liability
12.1 Nothing in these terms limits your Consumer Rights. Subject to them, we are not liable for loss or damage that was not reasonably foreseeable when you placed your order.

13. Privacy
13.1 We handle your personal information in line with our Privacy Policy.

14. Changes to these terms
14.1 We may update these terms from time to time. The version on our website when you place your order applies to that order.

15. Governing law
15.1 These terms are governed by the laws of New South Wales. This doesn't stop you from using a consumer protection agency or tribunal in your own state or territory.
